These Terms of Service ("Terms") govern all services provided by BuiltByMorning, a brand operated by Rapid City Digital LLC ("we," "us," or "our"), to you ("Client"). By completing a purchase, you agree to be bound by these Terms in full. Please read them carefully before placing your order.
BuiltByMorning provides professional static website design and development services. Each order includes the following deliverables:
Important: Websites delivered by BuiltByMorning are static HTML sites. They do not include a content management system (CMS), blogging functionality, e-commerce capabilities, or the ability for the Client to edit the site independently after delivery. If you require these features, please contact us before purchasing.
Any work requested beyond the scope defined above — including additional pages, features, copywriting changes, or post-launch updates — will be quoted and billed separately at $50/hr, billed in 30-minute increments.
All services are billed as a one-time flat fee of $297 USD, payable in full at the time of purchase via Stripe. No work will begin until payment is confirmed.
There are no recurring fees, subscriptions, or hidden charges associated with the base service. Hosting costs, domain registration fees, and any post-launch update fees are separate and disclosed in these Terms.
By completing your purchase, you authorize the one-time charge of $297 USD to your payment method on file.
We guarantee delivery of your initial website preview within twenty-four (24) hours of the Client submitting a complete intake form. The 24-hour clock begins only upon receipt of a fully completed intake form — not at the time of purchase.

We will notify you promptly if any delay is anticipated and provide a revised delivery estimate. In the event we are unable to deliver within 48 hours for reasons within our control, you may request a full refund.
Each order includes two (2) rounds of revisions prior to launch. A revision round is defined as a single consolidated list of requested changes submitted by the Client. We will action all changes in that list and return an updated preview within 24 hours.
Revision requests must be submitted within seven (7) days of receiving the preview link. Failure to respond within this window may result in the project being marked complete.
What counts as a revision: changes to text, colors, layout, images, or page structure within the original scope. Adding new pages, new features, or entirely new sections of content is considered out-of-scope and will be quoted separately.
Revisions beyond the two included rounds are billed at $50/hr in 30-minute increments, invoiced prior to work beginning.
Upon receipt of full payment and completion of the project, the Client owns all website content, including custom copy, page structure, and design as delivered. Ownership transfers fully to the Client upon project completion.
The Client represents and warrants that any materials provided to us (logos, photos, business information, copy) are owned by the Client or that the Client has the right to use them, and that their use will not infringe on any third-party intellectual property rights. The Client assumes full responsibility for any claims arising from materials they provide.
We retain the right to display completed work in our portfolio and marketing materials unless the Client requests otherwise in writing.
Websites are hosted on BuiltByMorning's Netlify account at no additional charge to the Client. While we cover hosting costs, the Client's site is deployed on infrastructure we manage and control.
In plain English: You own your domain and your content. We host it for free as part of the service. If you ever want to leave, just ask and we'll hand over all your files, no questions asked.
We stand behind our work. Our refund policy is as follows:
Refunds are processed through Stripe and typically appear within 5–10 business days. Note that payment processing fees (approximately 3%) are non-recoverable and will be deducted from refund amounts where applicable.
Refunds will not be issued for dissatisfaction arising from limitations clearly disclosed in these Terms (e.g., lack of CMS, inability to self-edit), or from inaccurate information provided by the Client on the intake form.

Failure to submit the intake form within thirty (30) days of purchase will result in order cancellation. A store credit valid for 90 days may be offered at our discretion.
BuiltByMorning provides website design and development services only. We make no guarantees, representations, or warranties regarding:
Basic SEO setup (title tags, meta descriptions, structured headings) is included as a best-effort service and does not constitute a guarantee of search engine visibility or ranking.
To the maximum extent permitted by applicable law, BuiltByMorning and Rapid City Digital LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to these Terms or our services, including but not limited to lost profits, lost revenue, loss of data, or business interruption.
Our total liability to you for any claim arising from or related to these Terms or the services provided shall not exceed the total amount paid by you for the applicable order ($297).
Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you.
We reserve the right to refuse or cancel service at our discretion, including if we determine that the requested website would promote illegal activity, violate third-party rights, or conflict with our values. In such cases, a full refund will be issued.
These Terms survive termination of the service relationship with respect to ownership, intellectual property, limitation of liability, and any outstanding payment obligations.
